BMI is an extremely inaccurate measure of health. In fact, 50% of people with a “high BMI” are metabolically healthy. But here’s the thing: you don’t need to be healthy to qualify for treatment. Denying someone medical care based on their height and weight is, by definition, discrimination. Doctors are obligated to practice medicine fairly and without bias, yet many continue to use BMI as an excuse to withhold care.

The justifications for denying treatment based on BMI are not only discriminatory but easily refuted with evidence. Weight is not a modifiable factor—almost all attempts at weight loss fail within two years. Even more concerning, intentional weight loss is extremely harmful. Doctors have a responsibility to “do no harm,” and perpetuating harmful weight loss practices violates that fundamental principle.

Jean had been been told she couldn’t have a knee replacement until her BMI was under 30. Apparently the procedure was too high risk and she was told that losing weight prior to surgery would improve her long term outcomes. I showed her the evidence that disproved both of these statements, and together we created a plan to appeal the decision. 

Jay needed a laparoscopic procedure for their endometriosis. The pain had a detrimental affect on their quality of life. Their gynecologist refused to perform the procedure even though it was a low risk day case. Together we wrote a formal complaint letter outlining why this was a breech of the doctor’s duty of care. 

Ricky had a gastric bypass 3 years ago, and developed gallstones a few months later. He had been admitted to hospital twice with sepsis and needed to have his gallbladder removed. His GI surgeon refused because his BMI wasn’t low enough. Since gallstones are a recognised complication of weight loss surgery, we argued that doctors had duty of care to operate on him.
